Kuwait Changes Housing Loan Rules: What Happens If Borrowers Fail to Pay?
Kuwait has introduced new rules for housing finance, offering citizens more financing options and setting clear procedures for people who struggle to repay their home loans.

Kuwait introduces new housing finance rules, allowing loan rescheduling for up to five years and setting clear protections for borrowers facing payment difficulties.
New Housing Finance Options for Citizens
Under Decree-Law No. 114 of 2026, eligible Kuwaiti citizens can obtain housing finance from local banks and financial institutions. This option will work alongside existing housing loans provided by Kuwait Credit Bank.
The financing will mainly cover two purposes: purchasing residential properties from approved developers or building homes on government-allocated land.
What Happens If Someone Fails to Repay a Loan?
One of the key changes concerns borrowers who face difficulties making their loan payments.
Under the new rules, financial institutions must formally notify borrowers before taking further action. They can also reschedule financing for up to five years, following the instructions of the Central Bank of Kuwait.
Importantly, payment difficulties will not automatically result in foreclosure or the immediate sale of a borrower's home.
Government Support and Borrower Responsibilities
If a borrower defaults, Kuwait Credit Bank will pay the remaining balance of the subsidized financing to the lending institution on behalf of the state.
However, this does not remove the borrower's financial responsibilities. The bank can still recover the amount paid from the borrower under the applicable rules.
When Will the New Rules Take Effect?
The law will become effective once its executive regulations are published in the official gazette. These regulations are expected within six months of the decree's publication and will provide further details about how banks must handle housing finance and loan defaults.
The new framework aims to expand housing finance options while establishing clearer procedures for borrowers and financial institutions.
