KARACHI — The Federal Board of Revenue’s (FBR) latest issuance of S.R.O. 1109(I)/2026—introducing a proposed special tax procedure for small shopkeepers—represents yet another statutory formalization of the state’s long-standing failure to enforce real-income taxation on the retail sector, effectively bringing tax policy back to square one.

The proposed draft framework aims to simplify compliance for retailers and small business operators with annual turnovers under PKR 200 million, but critics warn it risks repeating the pitfalls of past presumptive tax regimes.

Key Features of the Proposed Special Scheme

Under S.R.O. 1109(I)/2026, eligible small shopkeepers are offered a simplified, voluntary pathway to tax compliance:

Fixed Turnover Tax Rate: Tax is set at 0.75% of gross turnover, alongside a mandatory minimum cash tax payment of PKR 25,000 submitted with the return.

Exemptions & Safeguards: Participating retailers are exempt from section 153 withholding tax obligations on purchases and are not required to install Point-of-Sale (POS) e-invoicing systems.

Audit Protections: Opting shopkeepers will generally be shielded from routine departmental audits, except where third-party information indicates significant unaccounted transactions or misuse.

“Green Plate” Recognition: Compliant businesses will be awarded an FBR-certified “Compliant Shopkeeper Plate” featuring an NTN QR code to display at their business premises.

Back to Square One: Structural & Fiscal Concerns

Tax policy analysts argue that while past initiatives attempted to transition retail trade into a transaction-based, verifiable tax regime, the new proposal retreats into a blanket presumptive system.

Re-Institutionalizing Presumptive Tax: By allowing retailers to calculate “imputable income” based purely on fixed turnover payments rather than actual gross profit margins, the scheme creates legal cover for unexplained assets and wealth accumulation.

The Under-Declaration Dilemma: The core challenge of retail taxation in Pakistan has rarely been non-registration, but rather severe under-declaration of turnover. A low fixed rate offers little incentive for true revenue reporting.

Widening the Equity Gap: While salaried individuals and corporate entities face higher effective tax brackets, off-loading the retail segment into a low flat-rate pool risks exacerbating perceived inequities in the national tax policy framework.

Policy Dilemma: For over seven decades, successive governments have struggled to establish the state’s writ over the informal retail economy. Without robust third-party data integration and strict enforcement, voluntary turnover schemes risk functioning as statutory amnesties rather than sustainable structural reforms.
