SC reserves verdict on pleas against judgements review law

After hearing arguments from both sides, the Supreme Court (SC) deferred its decision on pleas challenging the Supreme Court (Review of Judgements and Orders) Act 2023.

A three-judge bench of the Supreme Court, led by Chief Justice Bandial and including Justice Ijazul Ahsan and Justice Munib Akhtar, heard the petitions challenging the constitutionality of the Supreme Court (Review of Judgements and Orders) Act 2023.

Continuing his comments, Attorney General of Pakistan (AGP) Mansoor Awan stated that the scope of review has grown as the scope of Article 184(3) has grown. Awan said that judges who made earlier decisions might be part of the broader bench hearing review petitions.

The Supreme Court still has the authority to form a bench, Awan said, adding that the court ruled in the Imran Tiwana case that the law cannot be suspended without a sound basis.

CJP Justice Umar Ata Bandial stated that the right to legislate remains with legislators, but they are discussing constitutional constraints here.

“We agree with your argument on remedy against 184(3), but the ground for remedy should be clarified,” CJP told AGP.

The Supreme Court has deferred its decision until the parties’ arguments are completed. The verdict in the judgements and review law would be announced soon, according to CJP Bandial.
