KARACHI — The Sindh High Court (SHC) has directed the Karachi Development Authority (KDA) to clear pending post-retirement and pensionary dues amounting to PKR 110 million for its former employees, reiterating that financial constraints cannot serve as a legal pretext to withhold accrued benefits.

A constitutional bench of the high court issued the directives while hearing petitions filed by retired workers seeking the immediate release of their long-overdue gratuity, commutation, provident funds, and monthly pensions.

Key Court Directives & Findings

The court expressed serious concern over the prolonged delays faced by retired public servants and outlined strict instructions to ensure timely disbursement:

Inviolable Legal Right: The bench ruled that pensionary benefits are not a matter of administrative discretion or financial convenience, but rather a vested and enforceable legal right linked to the dignity and livelihood of senior citizens.

Rejection of Financial Crunch Defense: While acknowledging KDA’s ongoing liquidity challenges, the court stressed that institutional revenue shortfalls cannot indefinitely suspend the statutory rights of retired employees.

Structured Timeframe: KDA authorities were instructed to process and release the outstanding PKR 110 million liabilities strictly in accordance with entitlement and seniority mechanisms established under judicial supervision.

KDA’s Recovery Plan & Funding Request

In response to the judicial orders, legal counsel for the KDA informed the court that the authority is actively pursuing measures to stabilize its financial position and meet its obligations:

Asset Liquidation: KDA plans to generate necessary funds through the planned auction and commercialization of designated departmental plots.

Provincial Support: The development authority has formally requested a grant from the Sindh Finance Department to help clear cumulative retirement liabilities across its workforce.

Judicial Stance: “Delayed payment of post-retirement benefits causes severe hardship and mental agony to former employees who depend entirely on these funds for their basic daily needs and medical sustenance.”
