The Pakistan Tehreek-e-Insaf (PTI) chairman’s sentencing in the Toshakhana case was overturned by the Islamabad High Court (IHC) on Tuesday.

The IHC issued the short decision it reserved a day earlier, ordering the authorities to release the PTI head on bail.

Following the conclusion of both sides’ arguments, a division bench led by IHC Chief Justice Aamir Farooq and comprised of Justice Tariq Mehmood Jahangiri issued the short order.

Petition

In the Islamabad High Court, the PTI chairman appealed the trial court’s denial of his right to defence in the Toshakhana case.

The petitioner asked the Supreme Court to overturn the trial court’s decision and restore his right to defend himself in the case. The PTI chief also asked the court to hear his case right away.

Toshakhana verdict

On August 5, the District and Sessions Court sentenced the PTI chairman to three years in prison in the Toshakhana criminal case.

The court also slapped a Rs 100,000 punishment on the PTI’s convicted chief. According to the court, the former prime minister was also barred from holding public office for five years.

The court found the defendants guilty of corrupt practices and sentenced the PTI chairman to three years in prison in its judgment.

“Imran Khan purposefully submitted false information [about Toshakhana gifts] to the ECP and was found guilty of corrupt practices,” he said.

According to the court, the former prime minister was also barred from holding public office for five years.
