CDA Makes Big Changes to Property Transfer System

The Capital Development Authority (CDA) stated on Wednesday that it had simplified procedures for property transfer and other processes to help citizens.

“We have gotten rid of unneeded requirements so that property-related issues can be dealt with quickly,” said the civic agency in a press release.

As per the initial announcement, the printing of transfer letters for the departments under Estate Management-I was to be centralized.

However, from August 1st, the assistant director of the One-Window Operation Directorate shall be responsible for admitting the case, printing the transfer letter, signing and stamping it, and then handing it over to the transferee on the same day.

The press release stated that instructions had been given to the Directorate of Information Technology to guarantee all arrangements were in place by August 1st.

The CDA said that at first, the process of issuing transfer letters for all sectors being dealt with by Estate Management-I had been centralized, after which the process of issuing transfer letters for properties in sectors dealt with by the Estate Affectees Section would be centralized.

The change in the requirement for obtaining a NOC from the Building Control Section for the transfer of properties to legal heirs under the inheritance law will now require legal heirs to submit an undertaking to the CDA that they will remove any illegal structures after completion of the legal heirship process. The prescribed processing fee of the Building Control Section must be deposited as per practice.

Under this process, once Estate Management-I, State Management-II and Estate Affectees Section receive an application/legal documentation for legal heirship, they will forward the case to Building Control Directorate in order to ascertain if any violations of Building Control Regulations have occurred.

If there are violations of Building Control Regulations, the legal heirs will need to submit an affidavit to CDA swearing that they will remove the violation within six months. However, the property cannot be transferred to the legal heirs until the violation of the Building Control Regulations 2020 is rectified.

If a property is classified as non-conferring use, the non-conferring use must be ended before it is transferred to the legal heirs.

Additionally, the time frame for issuance of No-Demand Certificate (NDC) by Estate Management-I and Estate Management-II has also been decreased to four days. With this in mind, instructions have been given to complete the process within four days of submitting the application.

The CDA board approved these initiatives a couple of months ago, and the civic agency is set to introduce them from August 1st. In the event of any legal complications, the allotted or applicant will be informed as to why the NDC was not issued on their request.
