Supreme Court Decides Women Can Assert Their Right to Haq Mehr at Any Time

The Supreme Court (SC) has affirmed that husbands are obligated to fulfill the payment of haq mehr upon the request of their wives, as stated in a written verdict released by the SC.

This ruling came in response to a plea filed by Khalid Parvez, challenging the Shariah provision of this right to his wife. Chief Justice of Pakistan (CJP), Justice Qazi Faez Isa, authored the three-page verdict.

In the written decision, the SC emphasized that the demand for haq mehr aligns with Shariah requirements and is safeguarded by Pakistani law. The verdict clarified that if the Nikkah does not specify a time for haq mehr payment, a woman is entitled to demand it at any point.

The court noted that this particular case, involving a woman seeking payment under her Shariah right, reached the Supreme Court after six years of legal proceedings. CJP, in the written verdict, highlighted that the complainant consistently filed pleas against the haq mehr provision in various courts, eventually bringing the matter to the SC.

Dismissing Khalid Parvez’s plea, the SC judgment underscored that had the complainant been penalized by lower courts, the case would not have escalated to the Supreme Court. Notably, the SC had imposed a fine of Rs100,000 on the man during the previous hearing of the case.
